This Journal declares that the copyright of the originals published, in the printed and electronic editions, of the Journal of Divulgaciones Matemáticas of the University of Zulia, correspond to and are the intellectual property of the authors. The Journal Divulgaciones Matemáticas of the Universidad del Zulia requests its authors and others that the citation of the source is mandatory for anyone who wishes to reproduce contents of this journal, being absolutely necessary to cite the origin in any partial or total reproduction of the contents ( texts or images) published, with the aim of guaranteeing and ensuring the widest dissemination and protection of published material, ensuring maximum international protection against violations, and disseminating the articles to the largest number of readers in the world.

Authors preserve their copyright and publication rights without restriction, under the ShareAlike 4.0 International Non-Commercial Public License (https://creativecommons.org/licenses/by-nc-sa/4.0/legalcode). The main terms and conditions are detailed below:

1.- Area of application:

1.1.- The journal grants the authors a global, free, non-transferable, non-exclusive and irrevocable license to exercise the copyright on the published work, to:

  • Reproduce and share the work in whole or in parts , only for commercial purposes.
  • Produce, reproduce and share the work for non-commercial purposes only.

1.2.- For the avoidance of doubt, where exceptions and limitations apply to the use of published work, this public license will not apply, and the author will have no need to comply with its terms and conditions.

1.3.- The magazine authorizes the author to exercise their rights in all media and formats, currently known or to be created in the future, and to carry out the technical modifications necessary for this. The journal waives and / or agrees not to assert any right or power to prohibit the author from making the technical modifications necessary to exercise these rights, including the technical modifications necessary to circumvent effective technological measures.

1.4.- The author may not offer or impose any different or additional terms or conditions, nor may he apply any effective technological measure to the published work, if doing so restricts the exercise of copyright to any recipient of the work.

1.5.- Nothing in this public license constitutes or can be construed as permission to state or imply that the author or his published work is connected, sponsored, endorsed or recognized as official journal status.

1.6.- Moral rights, such as the right to integrity, are not covered under this public license, nor are the rights of publicity and privacy or other similar personal rights. However, as far as possible, the journal waives and / or undertakes not to enforce any of these rights it holds, limiting itself to what is necessary for the author to exercise his rights, but not otherwise.

1.7.- Patent and trademark rights are not subject to this public license.

1.8.- To the extent possible, the journal waives the right to collect royalties from the author for the exercise of his rights, either directly or through a collective management entity under any voluntary, waivable or non-waivable licensing scheme. In all other cases, the journal expressly reserves any right to collect these royalties, including those cases in which the published work is used for purposes other than non-commercial.

2.- Attributions and recognitions:

2.1.- If the author shares the published work (including in modified form), he must:

  • Keep the following if it is provided by the journal with the published work: identification of the publisher of the published work and any other person designated to receive attributions and / or acknowledgments, in any reasonable manner requested by the journal; a copyright notice; a notice that refers to this public license; a notice that refers to the limitation of warranties; a URI or hyperlink to the published work to the extent reasonably practicable.

  • Indicate whether the author modified the published work and keep an indication of previous modifications.

  • Indicate that the published work is under this public license and include the text, URI or hyperlink to this public license.

2.2.- The author may satisfy the terms of this public license in any reasonable way depending on the medium, the manners and the context in which the published work is shared.

3.- About the basis of data:

3.1.- The journal grants the author the right to extract, reuse, reproduce and share all or a substantial part of the contents of the database, only for non-commercial purposes.

3.2.- If the author includes all or a substantial part of the content of the database in another one over which he holds database rights, then this content (but not its individual content) will be understood as adapted material for the purposes of this license.

3.3.- The author must comply with the conditions of this license if he shares all or a substantial part of the contents of the database.

4.- Disclaimer of warranties and limitation of liability:

4.1.- Unless the journal has been committed by a separate agreement, to the extent possible it offers published work as it is and as available and is not responsible or warranties of any kind with respect to this material, whether of express, implicit, legal or other way. This includes, but is not limited to, warranties of title, merchantability, fitness for a particular purpose, non-infringement, absence of hidden or other defects, the accuracy, presence or absence of errors, whether or not known or detectable. When the declaration of absence of guarantees is not allowed, totally or in part, the author may not be subject to this exclusion.

4.2.- To the extent possible, in no case will the journal be liable to the author for any legal theory (including, but not limited to, negligence) or otherwise for any direct, special, indirect loss, cost, expense or damage. , incidental, consequential, punitive, exemplary or otherwise arising from this public license or the use of the published work, even when the journal has been advised of the possibility of such losses, costs, expenses or damages. Where the limitation of liability is not permitted, either in whole or in part, the author may not be subject to this limitation.

4.3.- The waiver of warranties and the limitation of liability described above should be interpreted, as far as possible, as the closest thing to an absolute waiver and waiver of all types of responsibility.

5.- Validity and termination:

5.1.- This public license has a validity of application equal to the term of protection of copyright and similar rights granted in it. However, if the author violates the conditions of this public license, the rights granted to him by this same license automatically terminate.

5.2.- In those cases in which the rights to use the published work have been terminated in accordance with the provisions of this public license, it will be restored:

  • Automatically from the date on which the violation is corrected, as long as it is corrected within within 30 days of your discovery of the violation.

  • Aafter express reinstatement by the journal.

6.- Interpretation:

6.1.- For the avoidance of doubt, this public license is not and should not be construed as a reduction, limitation, restriction, or an imposition of conditions on the use of published work that may legally be done without permission of the author, beyond what is contemplated in this license.

6.2.- To the extent possible, if any provision of this public license is deemed unenforceable, it will automatically be modified to the minimum extent necessary to make it applicable. If the provision cannot be amended, it must be removed from this public license without affecting the enforceability of the remaining terms and conditions.

6.3.- No term or condition of this public license may be waived, nor will any breach be consented, unless expressly agreed with the journal.

6.4.- Nothing in this public license constitutes or can be construed as a limitation or waiver of the privileges and immunities that apply to the journal or the author, including those arising from legal processes of any jurisdiction or authority.
